Terms of Service

This Utility Data Authorization Agreement explains what you are authorizing when you allow InstaPull to access utility account information, retrieve utility bills and usage data, and provide that information to the person or company you selected.

For purposes of this Agreement, “InstaPull,” “we,” “us,” or “our” means Niche Business Management Systems, LLC d/b/a InstaPull. “You” or “your” means the utility account holder or an authorized representative of the utility account holder.

By submitting an authorization request, providing utility login information, approving access, forwarding a multi-factor authentication code, or otherwise using InstaPull’s services, you agree to this Agreement.

If you do not agree, do not submit utility account information or authorize InstaPull to access the account.

1. Purpose of This Authorization

InstaPull helps retrieve utility account information from utility websites, portals, bills, usage files, and related sources. The purpose of this authorization is to allow InstaPull to collect and organize utility data so it can be provided to the person or company you authorized.

This may include use by an energy broker, consultant, solar company, community solar provider, property manager, energy management company, software provider, or another service provider you selected.

InstaPull is not your utility company. InstaPull does not provide electric, gas, water, sewer, steam, or delivered fuel service. InstaPull does not enroll you in an energy supply contract, change your utility service, or make purchasing decisions on your behalf.

2. Your Authority to Authorize Access

You represent that at least one of the following is true:

  1. you are the utility account holder;
  2. you are an employee, officer, owner, manager, agent, or representative authorized to act for the utility account holder;
  3. you have permission from the account holder to provide account information to InstaPull; or
  4. you are otherwise legally permitted to authorize InstaPull to access the utility account.

If you are authorizing access for a business, organization, property, client, or customer, you confirm that you have authority to do so.

You agree not to submit account numbers, login credentials, security information, or authorization details for any account you are not permitted to access.

3. What You Authorize InstaPull to Do

You authorize InstaPull to take the actions reasonably necessary to retrieve utility data from the applicable utility account.

This may include:

  1. logging in to the utility account or utility portal;
  2. using account information, usernames, passwords, security answers, one-time codes, or multi-factor authentication information you provide;
  3. navigating the utility website or portal;
  4. downloading bills, usage files, interval files, green button files, account records, and other available utility documents;
  5. collecting account, meter, premise, service address, tariff, rate, billing, usage, demand, and charge information;
  6. converting utility information into standardized formats;
  7. creating structured outputs such as JSON, CSV, API responses, spreadsheets, summaries, reports, or extracted bill data;
  8. storing retrieved information as needed to provide the service;
  9. sharing retrieved information with the party or parties you authorized; and
  10. communicating with you or the authorized recipient about the status of the request.

This authorization is limited to utility data access and retrieval. Unless you separately authorize it in writing, InstaPull is not authorized to:

  1. change your utility service;
  2. switch your energy supplier;
  3. enroll you in a new program;
  4. cancel or modify utility service;
  5. make payments;
  6. update payment methods;
  7. change billing preferences;
  8. change mailing addresses;
  9. accept new utility terms on your behalf, except where reasonably necessary to access data you authorized; or
  10. take any action unrelated to retrieving and delivering utility data.

4. Credentials, MFA Codes, and Security Prompts

Some utility accounts require usernames, passwords, verification codes, security questions, email codes, SMS codes, authenticator app approvals, or other forms of multi-factor authentication.

By providing this information to InstaPull, you authorize InstaPull to use it only for the purpose of accessing the applicable utility account and retrieving utility data.

You understand that:

  1. utility portals may require repeated authentication;
  2. MFA codes may expire quickly;
  3. a retrieval request may fail if the code is not received in time;
  4. the utility may block or challenge access;
  5. credentials may stop working if changed, expired, locked, revoked, or entered incorrectly; and
  6. InstaPull may ask for updated information if access fails.

You should not provide credentials or MFA codes for any utility account you are not authorized to access.

5. Utility Data InstaPull May Retrieve

Depending on the utility, account type, portal, permissions, and data availability, InstaPull may retrieve information such as:

  1. account holder name;
  2. customer name;
  3. account number;
  4. billing address;
  5. service address;
  6. premise or service identifier;
  7. meter number;
  8. meter type;
  9. utility provider;
  10. commodity type;
  11. rate class, rate code, tariff, or service classification;
  12. billing period;
  13. bill issue date;
  14. due date;
  15. total amount due;
  16. charges, credits, fees, taxes, riders, adjustments, and line items;
  17. payment information shown on the bill;
  18. usage, consumption, demand, interval, or load data;
  19. generation, export, net usage, solar, or distributed energy data where available;
  20. peak, off-peak, super off-peak, seasonal, or time-of-use data;
  21. capacity, transmission, demand, or related billing determinants where available;
  22. bill PDFs, bill images, usage downloads, green button files, and related documents; and
  23. other utility account information made available through the utility portal or provided by you.

Not all utilities make the same information available. Some accounts may not support interval data, downloadable usage files, historical bills, demand data, or certain billing details.

6. Data Formatting and Delivery

InstaPull may convert retrieved utility information into standardized formats for easier review, analysis, import, or integration.

Outputs may include:

  1. raw bill PDFs;
  2. extracted bill data;
  3. JSON files;
  4. CSV files;
  5. spreadsheets;
  6. API responses;
  7. normalized account, meter, and usage records;
  8. billing summaries;
  9. historical usage tables;
  10. interval data files; and
  11. other structured or semi-structured formats.

InstaPull may provide these outputs to you, to the authorized recipient, or through a connected platform, API, dashboard, file export, or other delivery method.

7. Authorized Recipients

You authorize InstaPull to share retrieved utility data with the person, company, platform, or service provider identified in the authorization request or related workflow.

That authorized recipient may use the data for purposes such as energy analysis, procurement, community solar enrollment review, solar evaluation, benchmarking, reporting, billing review, sustainability analysis, or other services you requested from that recipient.

Once InstaPull provides utility data to an authorized recipient, that recipient’s use of the data is governed by your relationship with that recipient and any applicable agreement or privacy policy between you and that recipient.

InstaPull is not responsible for the actions, advice, products, services, or data practices of third parties that you authorize to receive your utility data.

8. Limits of InstaPull’s Role

InstaPull’s role is limited to data access, retrieval, extraction, organization, standardization, and delivery.

InstaPull does not:

  1. verify that your utility charges are correct;
  2. guarantee utility savings;
  3. provide legal, tax, accounting, engineering, or financial advice;
  4. act as your energy supplier;
  5. act as your regulated utility;
  6. decide whether you should enroll in any product, supplier agreement, solar program, community solar program, or energy service;
  7. guarantee that an authorized recipient’s analysis is correct; or
  8. control what information a utility makes available.

You should review any energy-related decision with the appropriate advisor, provider, broker, consultant, or utility.

9. Utility Portal and Data Limitations

You understand that utility data retrieval may not always succeed.

Utility portals may change without notice. Utilities may update their websites, change authentication methods, block automated access, remove downloadable files, alter bill formats, add MFA requirements, restrict historical data, experience outages, or provide incomplete information.

InstaPull does not guarantee that:

  1. all requested data will be available;
  2. all historical bills can be retrieved;
  3. all meters will be visible;
  4. all interval data will be downloadable;
  5. all fields will be available for every utility;
  6. every bill line item will be extracted perfectly;
  7. every account type will be supported;
  8. every login attempt will succeed; or
  9. utility data will be error-free, current, or complete.

If data retrieval fails, InstaPull or the authorized recipient may request additional information from you, such as updated credentials, MFA codes, account numbers, bill PDFs, or confirmation of account access.

10. Your Responsibilities

You agree to:

  1. provide accurate and complete information;
  2. keep utility login information current if ongoing access is requested;
  3. promptly provide MFA codes or security information when needed;
  4. notify InstaPull or the authorized recipient if your authority to access the account changes;
  5. notify InstaPull if you want to revoke authorization;
  6. use the service only for lawful purposes;
  7. not interfere with InstaPull’s systems or data retrieval process; and
  8. not submit information that is false, misleading, fraudulent, or unauthorized.

You are responsible for confirming that the authorized recipient is someone you want to receive your utility data.

11. Revoking Authorization

You may revoke this authorization by contacting InstaPull at:

To help us locate your authorization, please include available details such as:

  1. your name;
  2. email address;
  3. utility provider;
  4. account holder name;
  5. account number, if available;
  6. authorized recipient; and
  7. a statement that you want to revoke authorization.

After revocation, InstaPull will use commercially reasonable efforts to stop future retrievals under that authorization.

Revocation may not affect data already retrieved, processed, delivered, stored for recordkeeping, or shared with an authorized recipient before InstaPull processed the revocation request.

12. Data Retention and Privacy

InstaPull may store utility data, authorization records, credentials, technical logs, files, and related information as needed to provide the service, troubleshoot issues, maintain records, improve extraction accuracy, support authorized recipients, comply with legal obligations, prevent misuse, and operate the platform.

InstaPull’s handling of personal information and utility data is also governed by InstaPull’s Privacy Policy.

InstaPull may use utility data and related information to:

  1. complete authorized data pulls;
  2. provide customer and technical support;
  3. improve utility data extraction and standardization;
  4. detect errors and resolve issues;
  5. maintain audit records;
  6. secure the platform;
  7. comply with applicable law; and
  8. operate and improve InstaPull’s services.

13. License to Process Utility Data

You retain any rights you have in your utility data.

You grant InstaPull permission to access, collect, copy, download, store, process, transform, normalize, transmit, and display utility data as reasonably necessary to provide the service, support the authorized recipient, operate the platform, improve data extraction, comply with law, and enforce this Agreement.

This permission continues for as long as reasonably necessary for those purposes, unless limited by applicable law or InstaPull’s Privacy Policy.

14. InstaPull Technology

InstaPull owns its software, workflows, platform, extraction methods, templates, code, data models, interfaces, documentation, APIs, designs, processes, and related technology.

You do not receive ownership rights in InstaPull’s technology by using the service or authorizing a data retrieval.

You may not copy, modify, reverse engineer, resell, sublicense, scrape, interfere with, or misuse InstaPull’s systems or technology.

15. Prohibited Uses

You may not use InstaPull to:

  1. access a utility account without permission;
  2. obtain utility data for fraudulent, unlawful, misleading, or unauthorized purposes;
  3. impersonate another person or company;
  4. bypass utility or InstaPull security controls;
  5. overload, disrupt, or interfere with the service;
  6. submit malware or harmful code;
  7. violate another person’s privacy or contractual rights;
  8. harass, discriminate, surveil, or harm another person;
  9. misrepresent the purpose of a data request; or
  10. assist anyone else in doing any of the above.

InstaPull may suspend, reject, or terminate any request that appears unauthorized, fraudulent, unlawful, risky, incomplete, or inconsistent with this Agreement.

16. Third-Party Systems

InstaPull may rely on or interact with utility websites, utility portals, cloud providers, communication tools, email systems, authentication services, file storage systems, APIs, and other third-party systems.

InstaPull does not control those third-party systems and is not responsible for their availability, security, accuracy, performance, policies, or terms.

Your use of utility portals and third-party services may be subject to separate agreements or policies.

17. No Warranty

To the maximum extent permitted by law, InstaPull’s services are provided “as is” and “as available.”

InstaPull disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of accuracy, completeness, merchantability, fitness for a particular purpose, non-infringement, availability, and reliability.

InstaPull does not warrant that:

  1. the service will always be available;
  2. utility data will always be retrieved;
  3. retrieved data will be complete or error-free;
  4. every utility, account, meter, tariff, bill, or data type will be supported;
  5. utility websites will remain accessible;
  6. MFA or credential-based access will always work; or
  7. standardized outputs will meet every business, regulatory, or technical requirement.

18. Limitation of Liability

To the maximum extent permitted by law, InstaPull will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or reliance damages, including lost profits, lost savings, lost revenue, business interruption, loss of data, or costs of substitute services.

InstaPull will not be liable for damages arising from:

  1. utility portal outages or changes;
  2. failed login attempts;
  3. expired MFA codes;
  4. unavailable utility data;
  5. inaccurate utility information;
  6. third-party recipient actions;
  7. unauthorized information submitted by you or someone acting through you;
  8. utility restrictions or account lockouts; or
  9. decisions made based on utility data or third-party analysis.

To the maximum extent permitted by law, InstaPull’s total liability arising out of or relating to this Agreement or the applicable authorization will not exceed the greater of:

  1. the amount you paid directly to InstaPull for the specific authorization giving rise to the claim; or
  2. one hundred dollars ($100).

Some jurisdictions do not allow certain limitations of liability, so some of these limitations may not apply. In that case, InstaPull’s liability will be limited to the greatest extent permitted by law.

19. Indemnification

You agree to defend, indemnify, and hold harmless InstaPull and its owners, officers, employees, contractors, service providers, affiliates, successors, and assigns from claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising from:

  1. your breach of this Agreement;
  2. your unauthorized submission of account information;
  3. your lack of authority to authorize access;
  4. your misuse of the service;
  5. your violation of law or third-party rights;
  6. a dispute between you and an authorized recipient;
  7. inaccurate information you provided; or
  8. a claim that InstaPull’s access was unauthorized because of information, credentials, or instructions you provided.

20. Governing Law

This Agreement will be governed by the laws of the State of Pennsylvania, without regard to conflict of law rules.

For disputes not subject to arbitration or another required process, the parties agree to venue in the state or federal courts located in [Insert County and State], unless applicable law requires otherwise.

22. Changes to This Agreement

InstaPull may update this Agreement from time to time.

If material changes are made, InstaPull may provide notice by posting the updated version, sending an email, presenting updated terms through the platform, or using another reasonable method.

The updated Agreement applies after its effective date. Continued use of the service after that date means you accept the updated Agreement.

23. Termination or Rejection of Requests

InstaPull may reject, suspend, or stop a request if:

  1. the authorization is incomplete;
  2. the credentials do not work;
  3. MFA cannot be completed;
  4. the utility blocks access;
  5. the account holder revokes authorization;
  6. InstaPull believes the request may be unauthorized or unlawful;
  7. the utility portal is unavailable or unsupported;
  8. continued access creates security, legal, operational, or business risk; or
  9. the request otherwise violates this Agreement.

24. General Terms

If any part of this Agreement is found unenforceable, the remaining parts will remain in effect.

InstaPull’s failure to enforce a provision does not waive its right to enforce that provision later.

This Agreement, together with any authorization form, privacy policy, platform terms, order form, or written agreement that applies, is the complete agreement regarding the authorization and utility data retrieval described here.

Sections that should reasonably survive termination or revocation will survive, including ownership, license, privacy, disclaimers, limitation of liability, indemnification, dispute resolution, and general terms.
